Terms of Service

By accessing or using the Prestige Contractors UK website (“the Website”), including any content, features, or membership services provided on or through the Website, you agree to abide by these Terms of Service (“the Terms”). These Terms apply to all users, whether you are a registered member, a visitor, or a third party accessing our services. If you do not agree to these Terms, please discontinue using the Website.

2. Membership Eligibility
To register as a contractor or use the directory services provided by Prestige Contractors UK, you must:
– Be at least 18 years old.
– Provide accurate and complete registration information.
– Agree to abide by all applicable laws and regulations.

We reserve the right to terminate or refuse any membership if we believe that you do not meet these eligibility criteria.

3. Membership Plans & Fees
By signing up as a member, you agree to pay any applicable membership fees as outlined during the registration process. Membership fees are non-refundable unless otherwise specified under certain circumstances or in line with applicable consumer laws. You may upgrade or downgrade your membership plan at any time, with the changes becoming effective at the start of the next billing cycle.

4. Account Security
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately. Prestige Contractors UK is not liable for any loss or damage arising from unauthorized use of your account.

5. Directory Listings & Contractor Profiles
As a contractor, you are required to provide truthful, accurate, and up-to-date information when creating and maintaining your profile. You may not post false or misleading content. Prestige Contractors UK reserves the right to review and remove any profiles or listings that violate our guidelines or these Terms, at our sole discretion.

6. Use of the Directory by Block Management Companies
Block management companies and property managers using the Website to search for contractors are responsible for verifying the qualifications, certifications, and insurance of any contractor they choose to engage. Prestige Contractors UK does not endorse or guarantee the work of any contractor listed on the platform.

7. Payment and Billing
If you choose to use paid features of the Website, you agree to the pricing and payment terms listed during registration or on the pricing page. All fees are billed in advance and may recur on a monthly or annual basis, depending on your chosen membership plan. Failure to pay any fees on time may result in suspension or termination of your membership.

8. Cancellations & Terminations
You may cancel your membership at any time by accessing your account settings or contacting customer support. Upon cancellation, your access to paid features will end at the conclusion of your current billing period. Prestige Contractors UK reserves the right to suspend or terminate any account at our discretion, especially for violations of these Terms or misuse of the platform.

9. Content Ownership & Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, and software, is the property of Prestige Contractors UK or its licensors and is protected by copyright, trademark, and other applicable laws. You are granted a limited license to access and use the Website for personal or commercial purposes, but you may not reproduce, distribute, or otherwise exploit any part of the Website without express written permission.

10. User Conduct
By using the Website, you agree to:
– Use the Website in compliance with all applicable laws and regulations.
– Not engage in any activity that may harm, disrupt, or interfere with the Website or its users.

To the fullest extent permitted by law, Prestige Contractors UK, its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Website, even if we have been advised of the possibility of such damages.

13. Indemnification
You agree to indemnify and hold harmless Prestige Contractors UK and its affiliates from any claims, liabilities, damages, or expenses arising out of your use of the Website, your violation of these Terms, or your infringement of any third-party rights.

14. Modifications to the Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and we will update the “Last Updated” date at the top of this document. Your continued use of the Website after such changes constitutes your acceptance of the new Terms.

15. Governing Law

16. No Guarantee of Work or Income
Prestige Contractors UK does not guarantee that membership on the platform will result in obtaining work, contracts, or additional income. The platform serves as a directory and connection service, but the outcome of any engagement between contractors and property management companies is solely the responsibility of the parties involved. Prestige Contractors UK does not guarantee or promise any specific level of success or business opportunities from using the Website.

Contractor Policy & Declaration

Please read this section carefully. By completing and submitting the information asked for within this form, you accept and agree to be bound by the terms and provision of this policy.

Definitions
• ” I/we/my/ myself/our /ourselves” means the Responsible Person completing this form on behalf of the named Company in section COMPANY INFORMATION
• “PSU” means Prestige Contractors UK Ltd. .
• “End Clientr” means the person or persons that has contacted you through the Prestige Contractors Portal to instruct work.

1) Prior to undertaking any work I/we will ensure that my/our employees and any subcontractors will work safely and comply with the Health & Safety at Work Act 1974 and all other relevant Health & Safety legislation and codes of practice and that our company is competent and adequately resourced to fulfil its obligations.

2) I/we will take reasonable care for the health and safety of ourselves and others who may be affected by our acts and omissions, including if I/we are visiting the site, or delivering supplies.

3) I/we will be responsible for ensuring that the site or area that I/ we are working in is safe and that safe working practices will be implemented to ensure the safety of myself/our employees I subcontractors.

4) I/we will ensure that sub-contractors appointed are competent to perform the tasks they are asked to undertake. I/we understand that I/we are responsible for ensuring that any subcontractor is made aware of these requirements and that they will comply with the same conditions as set out in this Policy.

5) Particular attention will be paid to ensure the safety of anyone else who could be affected by my/our activities.

6) I/we will ensure that I / all our staff have had the training and have the qualifications required to do the work. Including, but not limited to:
• When completing licensable asbestos work, an HSE license.
• Gas Engineers / Plumbers who are undertaking works on gas systems will be Gas Safe registered for the appropriate categories of work.
• Those undertaking electrical works will be registered with NICEIC or the ECA, ELESCA or NAPIT.
• Those completing oil fired installations will be OFTEC registered for the appropriate categories of work.

7) I/we understand and will comply with the Construction (Design and Management) Regulations 2015 and will complete a Construction Phase Plan prior to commencing work on site.

8) Work will be risk assessed prior to commencement and assessments and method statements will be prepared accordingly. The risk assessment will consider any aspects of fire and appropriate control measures. I/we understand that evidence of our risk assessments may be requested by PCU or the End Client.

9) I/we understand that a permit to work is required if during the initial risk assessment process any “hot works” (welding, grinding, naked flames etc.) is identified. I/we will advise PCU or the End Client if a Permit to Work is issued.

10) I/we will ensure that any works in progress are adequately safe guarded In between spells of inactive work and will ensure that appropriate signage and segregation is in place commencing any task.

11) Where work at height is required, the task will be risk assessed and appropriate access equipment used. The simple hierarchy below will be adopted for managing and selecting equipment for work at height:
• Avoid work at height whenever possible.
• Use work equipment or other measures to prevent falls.
• Where the risk of a fall cannot be eliminated I/we will use work equipment or other measures to minimize the distance and consequences of a fall.
• Ladders will only be used for temporary, short duration work and will be properly positioned and secured in place.

12) I/our staff will wear Personal Protective Equipment (PPE) appropriate for the task. If the work is to involve the use of any hazardous materials, then COSHH assessments will be in place and the appropriate PPE will be used.

13) All equipment used will be suitable for purpose and maintained and checked on a regular basis:
• All portable appliances will be regularly tested. I/we understand that evidence of testing / maintenance may be requested by PCU or End Client.
• All tools and equipment hired or provided for any tasks undertaken will be appropriate, in good working order and properly monitored and I/we will provide evidence records to PSU or End Client as and when requested.
• Any hired-in equipment will be left in a safe state, i.e. keys removed, when not in use, during and after the works are completed.
• Hazardous materials will be stored safely and securely, and no hazardous materials will be left onsite during or after the works are completed.

14) I/we will report any relevant accidents, incidents or near misses to the End Client as well as directly to the local-enforcing authority if applicable, as per The Reporting of Injuries Diseases and Dangerous Occurrences Regulations 2013 requirements. (RIDDOR www.gov.uk.riddor/index.htm )

15) I/we will alert the End Client to any dynamic dangers which may arise, which they may not be reasonably aware of, so that appropriate joint action may be taken.

16) Regular recorded inspections of the workplace will take place when the job extends to multiple days.

17) I/we will ensure that the work area is clean and tidy during and after the works are completed.

18) I/we will report to the End Client when the works are completed.

19) I/we accept the principles set out in this Contractor Policy and undertake to abide by them.

20) I/we confirm that all the information provided is accurate and insurance certificates and other dated documents are current. Any subsequent renewal or changes to these documents will be actioned prior to expiry and copies passed to PCU.
