Website Terms of Service & Contractor Participation Terms

  1. Acceptance of Terms

By accessing or using the Prestige Contractors Portal UK Ltd website (“the Website”), including any content, features, contractor directory, membership services or contractor participation services provided on or through the Website, you agree to be bound by these Website Terms of Service & Contractor Participation Terms (“the Terms”).

These Terms apply to all users of the Website, including but not limited to:

  • Registered Contractor Members;
  • Contractors participating under referral or exclusive partner arrangements;
  • Property Management Companies;
  • Facilities Management Companies;
  • Estate Management Companies;
  • Housing Associations;
  • Local Authorities;
  • Visitors to the Website; and
  • Any third party using our services.

If you do not agree to these Terms, you must not use the Website or submit a Contractor Vetting Form.

  1. Membership Eligibility

To register as a contractor on the Prestige Contractors Portal UK Ltd, whether as a paid Contractor Member or as a contractor participating under a referral or exclusive partner arrangement, you must:

  • Be at least 18 years old.
  • Provide accurate, complete and truthful registration information.
  • Maintain all licences, qualifications, certifications and insurance required to carry out your services.
  • Comply with all applicable legislation, regulations and industry standards.
  • Agree to be bound by these Terms.

Prestige Contractors Portal UK Ltd reserves the right to refuse, suspend or terminate any membership or participation where these requirements are not met.

  1. Membership Types

Prestige Contractors Portal UK Ltd offers different participation arrangements which may include:

  • Paid Contractor Membership.
  • Free contractor participation under referral or exclusive partner arrangements.

The services, benefits, visibility and functionality available under each arrangement may differ.

Contractors participating under a free arrangement acknowledge that:

  • No membership fee is payable unless they later upgrade to a paid membership.
  • Their profile visibility may be restricted to a referring client or partner organisation.
  • Participation does not guarantee enquiries, work, contracts or introductions.

Paid Contractor Members agree to pay any applicable fees as set out during registration or within their signed Membership Agreement.

  1. Account Security

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

If you believe your account has been compromised, you must notify Prestige Contractors Portal UK Ltd immediately.

Prestige Contractors Portal UK Ltd accepts no responsibility for any loss arising from unauthorised access resulting from your failure to maintain account security.

  1. Directory Listings & Contractor Profiles

Contractors are responsible for ensuring that all information contained within their contractor profile remains accurate, complete and up to date at all times.

This includes, but is not limited to:

  • Company information
  • Insurance certificates
  • Qualifications
  • Accreditations
  • Professional memberships
  • Contact details
  • Areas of coverage
  • Supporting documentation

Prestige Contractors Portal UK Ltd reserves the right to review, suspend, hide or remove any contractor profile where:

  • documentation expires;
  • inaccurate or misleading information has been supplied;
  • compliance requirements are no longer met;
  • the contractor breaches these Terms; or
  • continued participation is considered to present a reputational or commercial risk.
  1. Contractor Responsibilities

Each contractor acknowledges and agrees that they remain solely responsible for:

  • Maintaining valid insurance policies at all times.
  • Maintaining all licences, qualifications, registrations and accreditations necessary to carry out their services.
  • Keeping all compliance documentation current.
  • Complying with all applicable legislation and Health & Safety requirements.
  • All quotations submitted.
  • All contracts entered into with clients.
  • All works undertaken.
  • All employees and subcontractors engaged.
  • The quality of workmanship provided.
  • Any advice or recommendations given to clients.

Prestige Contractors Portal UK Ltd does not supervise, direct or manage the Contractor’s business activities.

  1. Independent Contractor Status

Contractors participate on the Prestige Contractors Portal as independent businesses.

Nothing contained within these Terms creates:

  • Employment;
  • Partnership;
  • Agency;
  • Joint Venture; or
  • Any authority for a contractor to act on behalf of Prestige Contractors Portal UK Ltd.

Prestige Contractors Portal UK Ltd does not supervise, inspect, certify, direct or control any works undertaken by contractors.

Any contract for works remains solely between the Contractor and the End Client.

  1. Use of the Directory by End Clients

Property Management Companies, Facilities Management Companies and other End Clients remain responsible for carrying out their own due diligence before instructing any contractor.

Whilst Prestige Contractors Portal UK Ltd operates a contractor vetting process, we do not warrant or guarantee the competence, financial standing, workmanship, availability or suitability of any contractor.

The decision to appoint any contractor remains entirely the responsibility of the End Client.

  1. Payment & Billing

Where a Contractor elects to purchase a paid membership, they agree to the pricing and payment terms displayed during registration or contained within their Membership Agreement.

Membership fees are payable in advance.

Failure to pay any applicable fees may result in suspension or termination of membership.

Free contractor participation arrangements do not require payment unless the contractor subsequently upgrades to a paid membership.

  1. Cancellations & Terminations

Contractors may cancel their membership in accordance with the terms of any applicable Membership Agreement.

Prestige Contractors Portal UK Ltd reserves the right to suspend, restrict or terminate any contractor profile where:

  • compliance documentation expires;
  • inaccurate information is supplied;
  • serious complaints are received;
  • these Terms are breached;
  • continued participation presents a reputational or commercial risk; or
  • participation is no longer considered appropriate.

Suspension or termination shall not create any entitlement to compensation.

  1. Content Ownership & Intellectual Property

All Website content including text, graphics, logos, software, branding and intellectual property remains the property of Prestige Contractors Portal UK Ltd unless otherwise stated.

No content may be copied, reproduced, distributed or commercially exploited without prior written consent.

  1. User Conduct

Users agree that they will:

  • comply with all applicable laws;
  • not interfere with the operation of the Website;
  • not upload malicious software;
  • not submit false or misleading information;
  • not misuse the platform;
  • not damage the reputation of Prestige Contractors Portal UK Ltd or other users.

Prestige Contractors Portal UK Ltd reserves the right to suspend or terminate access where these requirements are breached.

  1. Disclaimers

Prestige Contractors Portal UK Ltd operates an online contractor directory and contractor introduction platform.

Prestige Contractors Portal UK Ltd:

  • does not employ contractors;
  • does not supervise contractors;
  • does not inspect works;
  • does not manage projects;
  • does not guarantee workmanship;
  • does not guarantee contractor availability;
  • does not guarantee the accuracy of information supplied by contractors.

End Clients remain responsible for satisfying themselves that any contractor they appoint is suitable for the works required.

  1. Limitation of Liability

To the fullest extent permitted by law, Prestige Contractors Portal UK Ltd, its directors, employees and representatives shall not be liable for:

  • workmanship;
  • defective works;
  • delays;
  • contractual disputes;
  • payment disputes;
  • property damage;
  • personal injury;
  • financial losses;
  • negligence committed by contractors;
  • acts or omissions of contractors.

Prestige Contractors Portal UK Ltd’s role is limited to operating the contractor portal and facilitating introductions between contractors and End Clients.

Nothing within these Terms excludes liability where such exclusion is prohibited by law.

  1. Indemnification

You agree to indemnify and hold harmless Prestige Contractors Portal UK Ltd, its directors, employees and representatives from any claims, losses, liabilities, legal proceedings, damages, costs or expenses arising from:

  • works undertaken by your business;
  • breach of these Terms;
  • negligence;
  • inaccurate information supplied during registration;
  • infringement of third-party rights.
  1. Modifications to these Terms

Prestige Contractors Portal UK Ltd reserves the right to amend these Terms from time to time.

Updated versions will be published on the Website together with the revised “Last Updated” date.

Continued use of the Website following publication constitutes acceptance of the revised Terms.

  1. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. No Guarantee of Work or Income

Prestige Contractors Portal UK Ltd does not guarantee that participation on the platform, whether as a paid Contractor Member or under a free referral or exclusive partner arrangement, will result in:

  • enquiries;
  • quotations;
  • work;
  • contracts;
  • additional income; or
  • business opportunities.

The Website operates solely as a contractor directory and contractor introduction platform.

  1. Participation Under Referral & Exclusive Partner Arrangements

Contractors participating under a referral or exclusive partner arrangement acknowledge that:

  • participation is offered entirely at the discretion of Prestige Contractors Portal UK Ltd;
  • profile visibility may be restricted to specific clients or partner organisations;
  • participation may be withdrawn at any time where compliance documentation expires, inaccurate information is supplied, serious complaints are received or Prestige Contractors Portal UK Ltd reasonably considers continued participation inappropriate.

Contractor Policy & Declaration

Please Read Carefully

By completing and submitting this Contractor Vetting Form, you confirm that you are authorised to act on behalf of the Contractor named within this application.

By submitting this form, you acknowledge that you have read, understood and agree to be bound by:

  • The Prestige Contractors Portal UK Ltd Website Terms of Service & Contractor Participation Terms;
  • This Contractor Policy & Declaration; and
  • Where applicable, any separate Membership Agreement entered into with Prestige Contractors Portal UK Ltd.

If you do not agree to these documents, you must not submit this Contractor Vetting Form.

Definitions

For the purposes of this Policy:

“Prestige” means Prestige Contractors Portal UK Ltd.

“Contractor” means the company completing this Contractor Vetting Form.

“End Client” means any property management company, facilities management company, estate management company, housing association, local authority, commercial organisation or any other client engaging the Contractor through the Prestige Contractors Portal.

“I”, “We”, “Our” means the authorised representative completing this Contractor Vetting Form on behalf of the Contractor.

Contractor Declaration

  1. I/We confirm that all work undertaken by our business will be carried out safely and in accordance with the Health & Safety at Work etc. Act 1974 together with all other applicable legislation, regulations, Approved Codes of Practice and relevant industry guidance.
  2. I/We will take all reasonable steps to protect the health, safety and welfare of:
    • our employees;
    • subcontractors;
    • End Clients;
    • members of the public; and
    • any other person who may be affected by our activities.
  3. I/We accept full responsibility for ensuring that every site under our control is maintained in a safe condition and that appropriate safe systems of work are implemented throughout the duration of the works.
  4. Where subcontractors are appointed, I/We confirm that:
    • they are competent to undertake the works assigned;
    • they hold appropriate qualifications and insurance;
    • they have been made aware of this Contractor Policy; and
    • they will comply with the same standards and obligations as our own employees.

The Contractor remains fully responsible for the actions of all subcontractors.

  1. I/We will ensure that particular consideration is given to protecting residents, visitors, building occupiers and any other persons who may be affected by our activities.
  2. I/We confirm that all personnel carrying out works are suitably trained, competent and appropriately qualified. Where applicable this includes, but is not limited to:
    • Gas Safe Registration;
    • NICEIC;
    • NAPIT;
    • ECA;
    • ELECSA;
    • OFTEC;
    • HSE Licences;
    • any other statutory or industry specific accreditation relevant to the works being undertaken.
  1. Where applicable, I/We will comply with the Construction (Design and Management) Regulations 2015 and prepare all documentation required before works commence, including Construction Phase Plans where necessary.
  2. Before commencing any works, suitable and sufficient Risk Assessments and Method Statements (RAMS) will be prepared where required. Where requested by Prestige or the End Client, copies shall be provided without unreasonable delay.
  1. Where Hot Works are identified, I/We will ensure that an appropriate Permit to Work system is implemented where required and all associated precautions are followed.
  2. I/We will ensure that all work areas are adequately secured during periods of inactivity through suitable barriers, signage and other appropriate control measures.
  3. Where work at height is required, I/We will follow the Work at Height Regulations and apply the following hierarchy:
    • avoid work at height wherever reasonably practicable;
    • prevent falls where possible;
    • minimise the consequences of any potential fall;
    • only use ladders for short duration or low-risk activities where appropriate.
  1. Suitable Personal Protective Equipment (PPE) will be provided, maintained and worn by all personnel where required.
    Where hazardous substances are used, appropriate COSHH assessments will be completed and suitable control measures implemented.
  1. All plant, tools and equipment used during works will:
    • be suitable for their intended purpose;
    • be maintained in safe working order;
    • be inspected where appropriate;
    • comply with applicable legislation.

Evidence of inspection, servicing or testing shall be provided upon reasonable request.

Hazardous substances shall be stored safely and securely and removed from site following completion of the works unless otherwise agreed.

  1. I/We will report all reportable accidents, dangerous occurrences and incidents in accordance with the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR) and will promptly notify the End Client where appropriate.
  2. Where any unforeseen hazards or risks become apparent during works, I/We will immediately notify the End Client and take appropriate action to minimise risk.
  3. Where works extend beyond one day, suitable site inspections will be carried out throughout the project to ensure continued compliance and safety.
  4. The work area will be maintained in a clean, tidy and safe condition throughout the duration of the works and left in an appropriate condition upon completion.
  5. The End Client will be informed promptly once works have been completed or where any significant issues arise affecting completion.
  6. I/We understand that Prestige Contractors Portal UK Ltd operates solely as an online contractor directory and contractor introduction platform.
    Prestige does not:
    • employ Contractors;
    • supervise Contractors;
    • inspect works;
    • certify workmanship;
    • manage projects; or
    • enter into contracts on behalf of Contractors.

All contracts for works remain solely between the Contractor and the End Client.

  1. I/We confirm and declare that:
  • all information provided within this Contractor Vetting Form is true, accurate and complete;
  • all insurance policies, licences, qualifications, accreditations and compliance documentation submitted are valid and current;
  • any future renewals or amendments will be uploaded to the Prestige Contractors Portal before expiry;
  • Prestige will be notified immediately of any material changes affecting our business, insurance, qualifications or legal status;
  • I/We have read, understood and agree to the Prestige Contractors Portal UK Ltd Website Terms of Service & Contractor Participation Terms;
  • I/We remain solely responsible for all quotations submitted, contracts entered into, works undertaken, employees, subcontractors, health and safety obligations, insurance requirements and statutory compliance relating to our business;
  • participation on the Prestige Contractors Portal does not guarantee enquiries, work, contracts, income or business opportunities;
  • Prestige Contractors Portal UK Ltd reserves the right to suspend, restrict or remove our contractor profile where compliance documentation expires, inaccurate information is supplied, serious complaints are received, or continued participation is considered to present a reputational or commercial risk.
